Aging may have already resulted in unique health concerns for you, so maintaining your health care coverage during your divorce process may be a critical concern.

Health Insurance and Divorce

As soon as you and your spouse decide on divorce, you’ll need to immediately take certain steps to ensure your existing health care coverage isn’t affected. If your spouse has coverage for you from an employer, then they may decide to drop your coverage. In addition, your former spouse may not pay the premiums on your health care. Depending on your circumstances, you may need to look for a replacement health care plan as soon as possible. Employer-provided coverage is typically the least expensive health care option. If you’re currently covered by your spouse’s employer, then you may be eligible for benefits under the Consolidated Omnibus Budget Reconciliation Act. This act can provide up to 36 months of coverage in the event of a divorce, but you must notify the plan administrator of the divorce within 60 days of it becoming final. If you don’t think you’ll be able to maintain your current health care plan, then you may need to purchase individual health insurance.
