According to People Magazine, Garner and Affleck are working with a top mediation attorney in Los Angeles. Mediation is an intelligent and non-adversarial way to divorce for many people. Unlike traditional adversarial divorce, the mediator works collaboratively with both members of the divorcing couple to arrive at an agreement. Mediation is less expensive than traditional divorce involving each partner’s attorney or legal team.
Perhaps it took Jen and Ben two years to file for divorce because many financial and legal teams worked away from the limelight to put the couple’s matters in order. The couple’s compilation of assets and business dealings is substantial. In addition, the couple probably negotiated a co-parenting agreement concerning their three children.
Tabloids noticed that the couple omitted the separation date. In California, the separation date is the cutoff date of community property. In other words, the couple’s income and assets accumulated during the marriage are equally divided up to the separation date.
However, Garner and Affleck have said that the intention to divorce is the reason that no separation date was noted. Legal experts believe that the lack of separation date on the divorce filing means that Jen and Ben have a deal and they don’t want to include the terms in the divorce papers.
